General terms of participation for the competitions run on Facebook and Instagram by the Friedrichstadt-Palast Betriebsgesellschaft mbH – hereinafter referred to as the “Organiser”
1. Scope / release of Facebook and Instagram from liability
These terms and conditions apply for all competitions run on Facebook (www.facebook.com/friedrichstadt.palast) and Instagram (www.instagram.com/friedrichstadt.palast).
The competitions run on Facebook and Instagram are in no way associated with Facebook, Inc., Facebook Ireland Ltd. or Instagram. They are not sponsored, endorsed or organised by Facebook or Instagram in any way, nor do they justify any legal claims against Facebook or Instagram. All competition information is provided exclusively by Friedrichstadt-Palast Betriebsgesellschaft mbH as the competition’s organiser.
2. Eligibility, entering the competition
By entering a competition, the Facebook/Instagram user expressly acknowledges these terms of participation.
The minimum age for entering the competition is 18 years. All fans of our Facebook page (www.facebook.com/friedrichstadt.palast) and followers on Instagram (www.instagram.com/friedrichstadt.palast) are entitled to enter the competition. Employees of Friedrichstadt-Palast Betriebsgesellschaft mbH and their affiliated companies in addition to competition partners are not eligible to enter the competition. The same applies for their relatives and/or life partners.
It is only possible to enter the competition using a personal (i.e. your own) Facebook/Instagram account. Should the Organiser learn of any technical manipulation or other violation of the terms of participation, the competition entrant shall be excluded from the competition. Technical manipulation includes submitting multiple entries or using a competition service or similar automated mass participation service to enter the competition. In such cases, a prize can also be revoked after it has been awarded and an alternative winner selected instead.
The competition begins when it is published on our Facebook or Instagram page. It is only possible to enter the competition during the period indicated.
Participation in the competitions involves commenting on the respective post on Facebook/Instagram or by registering on the Organiser’s website.
It is not possible to enter the competition after the competition has ended. The Organiser’s electronic record of the competition entry is decisive. The Organiser cannot be held responsible for any technical issues, e.g. faults in the telephone network or server errors, which prevent timely entry in the competition.
3. Competition prize / prize announcement / liability
The competition prize is as described in the Facebook/Instagram post.
The prize does not include travel to/from the Palast or accommodation.
Payment of the prize’s cash value or exchange of the prize is excluded. The right to a prize is not transferable.
Prize announcement/acceptance: the winners will be determined in a lottery or according to the Organiser’s specifications.
The winners will be informed of their win via the comment function for the Facebook/Instagram post or via email. If they have not already done so, each winner must then provide their address via a private message on the Friedrichstadt-Palast Facebook page or Instagram account within seven (7) working days.
Any recourse to courts of law is ruled out.
As the Organiser, Friedrichstadt-Palast Betriebsgesellschaft mbH is only liable for any claims arising in connection with competitions as a result of wilful intent or gross negligence by its employees or other vicarious agents. The Friedrichstadt-Palast Betriebsgesellschaft mbH is not liable as the Organiser for claims arising from the malfunction of technical equipment, delays or disruptions to transmissions or claims in connection with entering the competition.
Personal data shall be collected on the winners and their companions during the competition.
The Organiser requires this information to be able to run the competitions. Specifically, the Organiser will collect, store and use the name, postal address and email address of the relevant persons. In the event of a win, the winner agrees for their Facebook/Instagram profile picture as well as their name to be made public, also outside of Facebook and Instagram. As the Organiser, the Friedrichstadt-Palast Betriebsgesellschaft mbH is thus entitled to make the Facebook/Instagram profile picture and name of the winner public (also outside of Facebook/Instagram), for example on their website. The winner is entitled to withdraw their consent to this at any time. It is sufficient to send an email to [email protected] with the subject line of “Withdrawal of consent to the competition” for this and to mention relevant personal details (email, name, etc.).
6. Premature termination of competitions
The Organiser reserves the right to change competition components, or to cancel or end competitions without prior notice due to unforeseen circumstances. The latter particularly applies if software and/or hardware errors arise and/or other technical and/or legal reasons influence the regular and proper running of competitions or render this impossible.
The competitions are governed exclusively by the laws of the Federal Republic of Germany.
Should one or more of the above provisions be or become void, invalid or unenforceable in whole or in part, the remaining provisions shall not be affected. It shall be replaced with an according valid provision. The same shall apply in the event of any loopholes.
